Change of Registrant Agreement

PLEASE REVIEW THIS AGREEMENT CAREFULLY, AS IT CONTAINS VITAL INFORMATION CONCERNING YOUR LEGAL RIGHTS AND OBLIGATIONS.

INTRODUCTION
This Domain Name Change of Registrant Agreement (the “Agreement”) is established between HSJ.Host and you. It becomes effective upon your electronic acceptance. This Agreement outlines the terms and conditions of your use of HSJ.Host’s Change of Registrant services (the “Services”) to transfer a registered domain name from an existing or previous registrant (the “Prior Registrant”) to a new registrant (the “New Registrant”). It is relevant to both the Prior Registrant and the New Registrant.
Your electronic acceptance signifies your understanding and agreement to be bound by this Agreement, and by HSJ.Host’s Terms of Service, Domain Name Registration Agreement, Domain Name Transfer Agreement, and the relevant Australian Domain Name Dispute Resolution Policies, which are incorporated herein.

The terms “we”, “us”, or “our” refer to HSJ.Host. The terms “you”, “your”, or “User” refer to anyone who accepts this Agreement. No third-party rights or benefits are implied in this Agreement.

HSJ.Host, in its discretion, can modify this Agreement and any associated policies. Such modifications become effective immediately upon posting on the HSJ.Host website. Your continued use of our site or services following these changes means you accept the modified Agreement.

CHANGE OF REGISTRANT AND TRANSFER PROCESS; HSJ.Host's Role
Both the Prior Registrant and the New Registrant agree to this Agreement voluntarily. They acknowledge HSJ.Host's role as solely processing the change of registrant information and/or the transfer request. Both parties are responsible for the legality of any change of registrant information and/or domain name transfer.
Notably:

Following a change of registrant transaction, the domain may not transfer to another registrar within sixty (60) days.
Any subsequent change of registrant transaction within this period will restart the 60-day countdown.


REPRESENTATIONS AND WARRANTIES
You confirm that, on behalf of either the Prior or New Registrant, you possess the necessary authority to enter this Agreement. You represent that you are authorised to act as the Designated Agent for this purpose.

BINDING AGREEMENT
This Agreement is binding for both parties and their respective successors and assignees.

RELEASE FROM OBLIGATIONS
The Prior Registrant acknowledges prior agreements with HSJ.Host and releases HSJ.Host from any obligations or liabilities related to those agreements.

LIMITATIONS ON HSJ.Host’s LIABILITY
The New Registrant assumes responsibility for:

The actual registration by the Prior Registrant.
The transfer of registration legality.
Any conditions causing transfer delays.
The validity of the New Registrant’s domain name entitlement.


FURTHER LIMITATIONS
HSJ.Host is not liable for issues arising from domain name registration or use, access delays, data issues, application processing, or disputes.

LEGAL FEES
Should a dispute arise, the prevailing party is entitled to its legal fees.

.AU SPECIFIC PROVISIONS
For .AU domain registrations, the Registrant must meet specific criteria. The New Registrant acknowledges these conditions, and that failure to meet them may result in domain cancellation.

MISCELLANEOUS
The headings in this Agreement are for reference purposes. If any provision is deemed unenforceable, the remaining provisions remain in effect.

DEFINITIONS; DISCREPANCIES
Terms used but not defined here have meanings ascribed in the Terms of Service Agreement. In case of conflicts, this Agreement takes precedence.
