Domain name transfer agreement

PLEASE REVIEW THIS AGREEMENT THOROUGHLY AS IT CONTAINS CRUCIAL INFORMATION PERTAINING TO YOUR LEGAL RIGHTS AND OBLIGATIONS.

OVERVIEW
This Domain Name Transfer Agreement (“Agreement”) is initiated between HSJ.Host and you, and becomes effective as of the date of electronic acceptance. This Agreement outlines the terms and conditions of your usage of HSJ.Host's Domain Name Transfer services (“Services”) to transfer a registered domain name to HSJ.Host as the domain name registrar.
Your acceptance signifies your understanding and agreement to be bound by this Agreement, in addition to HSJ.Host’s Terms of Service, Domain Name Registration Agreement, and the relevant Australian Domain Name Dispute Resolution Policies.

The terms “we”, “us”, or “our” refer to HSJ.Host. The terms “you”, “your”, or “User” refer to the accepting individual or entity. This Agreement does not infer third-party rights or benefits.

HSJ.Host retains the right to alter this Agreement and related policies at its discretion. Changes become effective upon posting on the HSJ.Host website. Your continued use post-modification indicates acceptance of the revised Agreement. Ensure your account details, including your email address, remain updated.

HSJ.Host operates in compliance with the rules set by the relevant Australian domain name authorities and may modify this Agreement to maintain such compliance.

TRANSFER PROCESS
2.A. Steps for Transferring Your Domain Name Registration
Upon transfer completion, functions like RENEW, MODIFY DNS, etc., can be executed via your Account Manager. Provide all required data through the online transfer application, make the necessary payment, and update your Administrative Contact's email. HSJ.Host will seek transfer approval from this email. The transfer will initiate upon receiving the Administrative Contact's approval. Transfers get accepted or rejected by the previous registrar within five (5) days.

2.B. Failed or Rejected Transfer Requests
HSJ.Host may accept or decline your domain name transfer application for various reasons, including but not limited to:

Rejection by the current Registrar.
Recent registration or transfer of the domain name.
Locked status of the domain by the Registry or previous registrar.
Expired domain names.
Changes in Domain Name Registrant or Account.
Pending legal issues or disputes related to the domain name.

2.C. Terms for Transferring Domain Names
Post successful transfer, you remain the domain name's registrant while HSJ.Host becomes the registrar of record. The domain name registration transfers can only start after this Agreement's acceptance, payment, and obtaining the Administrative Contact's positive response. Ensure your account's email is updated as per the previous Registrar's WHO-IS database.

2.D. Transfers of Recently Renewed Domain Names
Transferring a recently renewed domain name might result in the loss of the renewal year, especially if renewed during a grace period after expiration. HSJ.Host isn't responsible for this lost year. It's advised to check the registration agreement with the previous registrar regarding potential refunds or credits.

2.E. Data for Domain Transfer
By accepting this Agreement, you request the domain name registration transfer from the current registrar to HSJ.Host. You acknowledge having entered a Domain Name Registration Agreement with HSJ.Host. You've read, understood, and agreed to be bound by all agreements governing domain names registered through HSJ.Host.

TITLES, HEADINGS, AND SEVERABILITY

DEFINITIONS AND CONFLICTS
Terms not defined here are as described in the Terms of Service Agreement. In case of conflicts, this Agreement prevails.
