HSJ Host AU Domain Name MacBook Giveaway – Terms of Service

Offer Expiry: The offer expires upon the registration of 5000 eligible domain names as defined below.
1. Overview
The HSJ Host AU Domain Name MacBook Giveaway (hereinafter referred to as "The Giveaway") is a promotional campaign organized by HSJ Host (hereinafter referred to as "The Company"). The Giveaway provides participants with the opportunity to win a MacBook Pro valued at A$2,999.00 (including GST of approx. A$273.00) by purchasing eligible domain names through the HSJ Host website.
2. Eligibility
Participants: The Giveaway is open to individuals and entities (hereinafter referred to as "Participants") who are 18 years of age or older and legally residing in Australia.
Excluded Parties: Employees, officers, directors, agents, and representatives of The Company, as well as their immediate family members, are not eligible to participate in The Giveaway.
3. Entry Criteria
Eligible Domain Names: Participants must purchase any of the following domain extensions to be eligible for entry:
.com.au
.net.au
.au
Entry Mechanism: Each purchase of an eligible domain name counts as one entry into The Giveaway. Participants can increase their chances of winning by purchasing multiple domains or registering a domain for multiple years. For example, a two-year registration will count as two separate entries.
Automatic Entry: Entry into The Giveaway is automatic upon successful payment and registration of the eligible domain name(s) through the HSJ Host website. No additional steps are required.
4. Giveaway Duration
- The Giveaway commences on 19/08/2024 at 00:00 Australian Eastern Standard Time (AEST).
- The Giveaway will automatically terminate upon the successful registration of 5000 eligible domain names, at which point no further entries will be accepted.
- The Company reserves the right to terminate The Giveaway early if unforeseen circumstances arise, as detailed in Section 9 of this document.
5. Prize Details
Prize Description: The prize consists of one (1) MacBook Pro with an 8-Core CPU, 10-Core GPU, 8GB Unified Memory, and 1TB SSD Storage.
Prize Value: The MacBook Pro is valued at A$2,999.00 (including GST of approx. A$273.00).
Prize Distribution: The winner will be selected at random from all eligible entries and will be notified via email within 14 days of the Giveaway’s conclusion.
6. Winner Selection and Notification
Random Draw: The winner will be chosen through a random draw conducted by The Company or its designated representatives. The draw will take place within seven (7) business days after the expiry of The Giveaway.
Notification: The winner will be notified via the email address associated with their HSJ Host account. The Company is not responsible for any failure to receive notifications due to spam, junk email filters, or other security settings, or for incorrect or non-functioning contact information provided by the winner.
Prize Claim: The winner must respond to the notification email within fourteen (14) days of its dispatch to claim their prize. Failure to do so may result in forfeiture of the prize, and The Company reserves the right to select an alternate winner in such an event.
7. General Conditions
Non-Transferable: The prize is non-transferable and cannot be exchanged for cash or other products.
Taxes: Any and all applicable federal, state, and local taxes and fees associated with the receipt or use of the prize are the sole responsibility of the winner.
Publicity: By entering The Giveaway, the winner agrees to allow The Company to use their name, likeness, and/or prize information for promotional and marketing purposes without additional compensation, unless prohibited by law.
8. Limitation of Liability
Disclaimer: The Company is not responsible for any technical malfunctions, human error, or other problems that may arise in connection with the operation of The Giveaway, including but not limited to, the following:
- Lost, late, misdirected, or undeliverable emails.
- Any damage to Participants' or any other person’s computer system or mobile device related to or resulting from participation or downloading any materials in connection with The Giveaway.
- Any incorrect or inaccurate information, whether caused by website users or by any equipment or programming associated with or utilized in The Giveaway.
Indemnification: By entering The Giveaway, Participants agree to release and hold harmless The Company, its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from:
- Participants’ participation in The Giveaway and/or their acceptance, possession, use, or misuse of any prize or any portion thereof.
9. Modification and Termination
Right to Modify: The Company reserves the right, in its sole discretion, to modify, suspend, or terminate The Giveaway should any virus, bug, non-authorized human intervention, fraud, or other cause beyond The Company’s control corrupt or affect the administration, security, fairness, or proper conduct of The Giveaway.
Early Termination: If The Giveaway is terminated prior to the achievement of 5000 domain registrations, The Company reserves the right to award the prize through a random draw from among all eligible, non-suspect entries received up to the time of termination.
10. Dispute Resolution
Governing Law: The Giveaway is governed by the laws of Australia, without respect to conflict of law doctrines. As a condition of participating in The Giveaway, Participants agree that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with The Giveaway, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Australia having jurisdiction.
Jurisdiction: All matters relating to the interpretation, construction, validity, and enforcement of these Terms of Service shall be governed by the laws of the State of Victoria, Australia.
11. Privacy
Data Collection: The Company will collect personal information about Participants for the purposes of administering The Giveaway. By entering The Giveaway, Participants consent to such collection, use, and disclosure of their personal information in accordance with The Company’s Privacy Policy.
Use of Data: The Company may use the information Participants provide to send announcements about its products and services. Participants can opt out of these communications at any time.
12. Acceptance of Terms
By participating in The Giveaway, Participants agree to abide by these Terms of Service and the decisions of The Company, which are final and binding in all matters relating to The Giveaway. Participants acknowledge that they have read and understood these Terms of Service.
